2010 Depreciation Provisions – Quick Reference Guide
With the myriad of Tax Acts being implemented, I thought having a quick reference guide for 2010 depreciation provisions would be useful. As they currently stand, below are the Bonus and Section 179 depreciation laws for 2010 and beyond
Small Business Jobs and Credit Act of 2010
Bonus Depreciation
1.50% first-year bonus depreciation extends through 12/31/10
2. Also extends through 2011 the additional year of bonus depreciation allowed for property with a recovery period of 10 years or longer, and for transportation property.
Section 179 Depreciation
1. Increases maximum deduction for qualified Section 179 property to $500,000 and the investment limit to $2,000,000 for tax years beginning in 2010 and 2011.
2. Expands the definition of qualifying Section 179 property to include qualifying real property, particularly certain leasehold improvements, restaurant property and retail improvement property.
Tax Relief/Job Creation Act of 2010
Bonus Depreciation
1. 50% first year bonus depreciation is boosted to 100% for qualified investments made after September 8, 2010 and before January 1, 2012.
2. 50% first year bonus depreciation is extended for qualified property placed in service after December 31, 2011 and before January 1, 2013.
Section 179 Depreciation
1. For tax years beginning in 2012, the Section 179 dollar limit is $125,000 and the investment limit is $500,000.
Please note that when you are applying these provisions, Section 179 must be taken first, then Bonus depreciation. Also, Bonus depreciation is only applicable to new property not used.

TWC Won’t Fully Reveal Names of Porn Pirates
Time Warner Cable is providing the names of accused pirates, just not the way attorneys want it.
CNET reports that Time Warner Cable has refused to hand over the names of subscribers accused of pirating a porn film distributed by Larry Flint Publishing (LFP).
According to the report, Dallas-based attorney Evan Stone filed three separate lawsuits in October–all three on behalf of Flints company–that targets over 4,000 John Doe offenders. The lawsuits claim that the defendants illegally shared the movie This Aint Avatar XXX using a peer-to-peer client (BitTorrent). The problem Stone faced is that he only possessed each defendants IP address– he couldnt match the numbers to the actual subscriber accounts without Time Warner Cables help.
Plaintiff has evidence that each and every defendant in this case was using the same .torrent reference file to obtain the exact same copy of Plaintiffs film, Stone wrote in documents filed with the court. They only could have obtained [this] from other defendants in this case or yet unlisted defendants who themselves had already obtained the film.
The documents go on to explain that BitTorrent piracy is pointless without a BitTorrent swarm. This swarm is the group of users that are connected to each other to obtain the data referenced in the .torrent reference file… such as a reference file for a motion picture, the documents read. For this process to work, each user must have the same .torrent file. It is not enough for a users .torrent file to merely reference a copy of the same motion picture. It must reference the same specific copy of the motion picture as everyone else in the swarm for that user to participate in the swarm.
Stone said that Time Warner Cable eventually agreed to hand over ten names per month, however Stone argued that the amount was totally unsatisfactory. LFP disagreed and asked Stone to back off, as Time Warner Cable was one of the companys business partners and LFPs managers were unwilling to challenge the popular ISP. Unable to come to an agreement, Stone and LFP decided to part ways.
If youre a pirate in these times, TWC is the ISP to have, Stone told CNET.
Stone isnt the only legal eagle facing a stone wall in dealing with Time Warner Cable. Law firm Dunlap, Grubb amp; Weaver launched a campaign against thousands of accused film pirates back in March 2010 on behalf of several independent film producers. Time Warner Cable refused to quickly hand over the names of accused customers, forcing Dunlap to drop the complaints. Instead, the firm had to work the cases using a slower approach.
Despite the collapse of the LFP campaign, Stone currently plans to continue on with the lawsuits against movie pirates on behalf of his other clients. I was born for [these kind of cases], Stone said. I put myself through school doing database programming and I earned a film degree before my law degree. I honestly think its my tech background that has saved me from making the same mistakes [Dunlap] made. Either way, this trend of BitTorrent litigation is a long way from over.

Facebook Reference Appears On Chinese Social Network

But not long after Mark Zuckerberg toured the country and met with business leaders, Facebooks name has been spotted in connection with a Chinese social network.
Some info to orient you: Tencent Holdings Limited is a Chinese tech company that reported $1.8 billion in revenue in 2009. It owns a popular messaging platform along with a lot of other social properties. And Tencent also owns the social network in question, PengYou.com. So while the circumstances are doubtful, they cant be dismissed.
Moving on, then, it seems some sort of Facebook authentication option was seen on PengYou.com. Mobinode reader Yu Junde captured a screenshot, and writer Gang Lu explained afterward, If you choose an oversea school/university for your education profile, the Facebook authentication will show up.
Not much else is known because no ones gotten the authentication process to work. So we may be looking at an early mockup of a tie-in, or just a mistake or joke.
Anyway, now more than ever, Facebook definitely has reason to want to do business in China. A fresh report indicates that there are 450 million Internet users in the country, compared to the entire US population of 310 million.

First Homicide of 2011
On New Years Day, Saturday, January 1, 2011 at 3:09 AM officers responded to the Timberlake Courts Apartment Complex located at 125 Interstate 10 North in reference to a fight in the parking lot.
Upon their arrival they found two men had been stabbed and the suspect was being held down by witnesses. Officers arrested the suspect and called EMS to the scene. One of the victims was bleeding profusely. He was transported by EMS to St. Elizabeth Hospital where he died of his injuries. The deceased victim isidentified as24 year old Jorge Elias DeleoanofBeaumont.
The second stabbing victim was only identified as a 20 year old Beaumont man. His injuries were not life threatening. His condition is not known at this time.
The investigation by officers and detectives revealed the suspect and his girlfriend had come to visit for the new year. The suspect had been drinking and gotten into an argument with the deceased victim. The suspects girlfriend went to get the car so they could leave but when she returned they were fighting. During the fight the suspect stabbed the victim. Several witnesses subdued the suspect but one of them was stabbed by the suspect during the struggle.
Marvin Rojas 26 of Beaumont was arrested and transported to the Jefferson County Jail. He was booked in for Murder and Aggravated Assault.The investigation is continuing.Bond has not been set on either charge.

‘iTunes Live Stream’ Reference Found in iTunes 10.1 Code
Ever since Cupertino, California-based Apple Inc. revealed this morning on its website that an exciting and unforgettable iTunes-related announcement will be made tomorrow, the entire tech blogosphere has been trying to find out what exactly the company will introduce tomorrow.
Theories vary greatly. However, one clue or hint has been found in the new iTunes 10.1 code. For instance, iTunes Live Stream references have been found in the code, which could suggest that Apple will announce some type of live streaming service tomorrow.
The company has been lately streaming live feeds of its latest keynotes. Some believe that the company was actually testing and preparing to roll out a wider service to the general public.
Its still unknown whether this has something to do with tomorrows announcement. Individuals must take into account that its very unlikely that Apple will unveil a cloud-based music, TV show, and movie streaming service, as licenses with record labels, TV networks, and movie studios respectively are required. Otherwise, the company could get sued. Thus far, theres no evidence that Apple has signed new license deals with anyone yet.

The first meeting of the Pacific Islands Forum Reference Group to Address Sexual and Gender-Based Violence (SGBV) was held on 16 November 2010 at the Pacific Islands Forum Secretariat in Suva.
The Reference Group to Address Sexual and Gender-Based Violence was established following a recommendation from the 2010 Forum Regional Security Committee meeting to assist the Forum Secretariat and support national efforts in taking forward a mandate from Forum Leaders in 2009 on this issue.
At their 2009 meeting, Forum Leaders noted that sexual and gender-based violence is a risk to human security and a potential destabilising factor for communities and societies alike. Leaders also acknowledged that SGBV remained pervasive across the Pacific, even though its prevalence often went underreported, and urged the recognition of its prevalence in the Pacific at all levels of community, whether in the domestic context or during conflict and post conflict situations.
The Reference Group extensively discussed issues pertaining to SGBV including existing work to address the issue by the different agencies across the Pacific. The Reference Group discussed and confirmed its Terms of Reference which include identifying, assessing and recommending activities , policies and legislation (including in the long term) to address existing and potential contributing factors to sexual and gender based violence.
Director Teurakai Ukenio of the Community Development and Social Services Division of the Ministry of Internal #038; Social Affairs, Kiribati, welcomed the initiative saying his participation was “a clear demonstration of the Kiribati Governments commitment to addressing sexual and gender based violence”. The Director also said “the issues highlighted in discussions included the importance of Pacific Islands Forum Governments’ accountability to implement national and international commitments to gender equality and human rights. The Reference Group also noted the importance of tracking and coordinating government budgetary allocations and aid to address SGBV, to ensure the most strategic and effective implementation of efforts to eliminate violence against women and children.”
The Reference Group comprises Ms Ethel Sigimanu, Permanent Secretary for the Ministry for Women, Youth and Children’s Affairs, Solomon Islands; Mr Teurakai Ukenio, Acting Director Community Development #038; Social Services Division, Ministry of Internal #038; Social Affairs, Kiribati; Commander Chris Kelley, Commander, Royal Tonga Police, Tonga; Ms Elizabeth Cox, Regional Director, UNIFEM Pacific; Mrs Fekitamoeloa K. ‘Utoikamanu, Deputy Director-General, Secretariat of the Pacific Community; and Ms Shamima Ali, Director, Fiji Women’s Crisis Centre.
